YOU AND ARKANSAS CATFISH LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.

Unless both you and Arkansas Catfish LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class, collective, or representative proceeding. If this class action waiver is found to be unenforceable for any reason, then the arbitration agreement in Section 8 shall be null and void with respect to such proceeding, and the parties agree to have that proceeding resolved in a court of competent jurisdiction.

You agree to waive any right to a jury trial for any claim covered by this agreement.
